Personal Plan - What is Included?

Your Personal Plan includes many types of legal documents, which are collectively known as Advance Directives. Advance Directives may include the following documents, as well as others:

Whether you are 18 or 88 you should have a will. A will is just one piece of the puzzle that you should be putting together to build your Personal Plan. Planning for the distribution of your assets, whether you distribute them during your lifetime or after your death, gives you control over where they go. In addition, planning can help minimize what are sometimes known as "death taxes." You should consult an attorney to understand the tax consequences of your Personal Plan.

Finally, it is important to make sure that your will and other Personal Plan documents are up to date. Can the person you appointed as executor still fulfill his or her responsibilities? Have you gotten married and need to include your spouse or children in the will or trust? Remember, the will you created when you were 25 and single is not going to work when you are 35 and married with two children.

Trusts - Living, Revocable, and Other Types

There are many types of trusts that can be used to control where your assets go both during your lifetime and after your death. These may include:

A trust usually has a trustee (the person appointed to manage and fulfill the terms of the trust) and one or more beneficiaries. Different trusts serve different purposes, and it is important to work with an experienced attorney to create the types of documents and devices that will work best for you and your wishes.
